Outdoor Behavioral Therapy Class Actions

In the last six months, I – along with colleagues from a number of gold standard commercial law firms – have commenced class actions seeking the recovery of insurance benefits on behalf of families who have sought treatment at outdoor behavioral therapy programs for alcohol and drug addiction and mental illness. The cases are all brought under the federal Mental Health Parity and Addiction Equity Act, which requires that there are no separate treatment limitations applicable only to mental health benefits. My clients are seeking unpaid benefits on their own behalf and on behalf of similarly situated insureds as well as a court order requiring the insurers to conform to the Parity Act.
