Firm Client Challenges “Against Medical Advice” Retroactive Exclusion
Firm that client Sariah Morgan has commenced a class action lawsuit against the health insurer covered her minor daughter for denying coverage retroactively after the daughter left an eating disorder hospital against medical advice. Between June 15, 2021 and July 5, 2021, the daughter was treated at the Toledo Center for Eating Disorders; the treatment was pre-authorized by the health insurer, Physicians Health Plan of Northern Indiana, Inc. On July 6, 2021, the daughter’s parents removed the child from the clinic so that she could focus on other areas of her recovery. Invoking a so-called “Against Medical Advice” exclusion, Physicians Health Plan denied coverage for the entire period. Plaintiff Morgan alleges that, applied retroactively, the denial breaches the health insurance contract. The claim is brought as a class action.
