Firm Client Defeats Blue Cross Motion To Dismiss, Health Insurer’s Offset Practices At Issue
On March 24, 2020, a Minnesota federal district court judge adopted a magistrate’s report that recommended that a firm’s client’s case that challenges the “offset” practices of Blue Cross and Blue Shield of Minnesota. The case, captioned J.P. and M.K. v. BCBSM, Inc., concerns the health insurer’s practice of collecting claimed overpayments to one of its insureds by reducing benefits it owes to other family members. The Minnesota court rejected Blue Cross’s motion to dismiss, permitting the case to commence discovery.
