Magistrate Ruling Affirmed By Trial Judge

On February 28, 2020, the Trial Court adopted a Magistrate’s Recommendation that summary judgment be granted in part in favor of a firm client challenging his daughter’s denial of coverage at a residential treatment center. The ruling, in effect, finds that the insurer, Blue Cross and Blue Shield of Minnesota, violates the federal Mental Health Parity and Addiction Equity Act by imposing more restrictions on mental health coverage than on comparable medical surgical coverage.
