The federal Fair Debt Collection Practices Act and the Florida Deceptive and Unfair Trade Practices Act provide recourse for consumers who have been cheated or otherwise been subject to sharp business practices. As an example, I was co-lead counsel to a Florida case that returned 100 cents on the dollar to a class of about 4,000 Florida consumers who – we argued – were improperly charged fees on NSF checks. I also represented a class of bankrupt Chapter 13 estates who were charged for “debts” that had previously been discharged through Chapter 7 bankruptcies. That case, too, resulted in a 100% recovery to the affected estates.
